Agreement to Terms
By downloading, installing, or using PomBar ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
License
PomBar is licensed, not sold. Upon purchase through the Mac App Store, George DeLair ("we," "our," or "us") grants you a limited, non-exclusive, non-transferable license to use the App on any Apple devices you own or control, as permitted by the Mac App Store terms.
Permitted Use
You may:
- Use PomBar for personal or commercial productivity purposes
- Install the App on multiple devices you own, as permitted by the Mac App Store
You may not:
- Reverse engineer, decompile, or disassemble the App
- Redistribute, sell, lease, or sublicense the App
- Remove or alter any proprietary notices or labels
- Use the App for any unlawful purpose
Intellectual Property
PomBar and all associated trademarks, logos, and content are the property of George DeLair. All rights not expressly granted are reserved.
Disclaimer of Warranties
PomBar is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.
Limitation of Liability
To the maximum extent permitted by law, George DeLair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or productivity, arising from your use of or inability to use the App.
Our total liability for any claim arising from the App shall not exceed the amount you paid for the App.
Updates
We may release updates to PomBar from time to time. These Terms apply to all updates unless the update includes separate terms.
Termination
Your license to use PomBar continues until terminated. Your rights terminate automatically if you fail to comply with these Terms. Upon termination, you must stop using the App and delete all copies.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Changes to Terms
We may update these Terms from time to time. Changes will be indicated by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
Mac App Store
Your purchase and use of PomBar is also subject to Apple's Mac App Store Terms of Service and Apple's Standard End User License Agreement (EULA).
